<p>Recently, I had an incident with a buyer that I wanted to share with my readers in order to get feedback.  As you may know I&#8217;ve been selling domain names on eBay for many years now and I&#8217;ve always had the following disclaimer in each eBay listing:</p>
<p><em>If the domain(s) purchased are not accepted by the buyer into their own Godaddy account within 30 days then all rights to the purchased domain(s) will be forfeited and no refunds will be given. Please accept your domains in a timely fashion. Multiple attempts will be made within 30 days to remind the buyer to claim the domain(s) purchased.</em></p>
<p>Now my normal process is that once I sell a domain and receive payment for it I will not consider the sell closed until I have received confirmation from Godaddy that the domain has been accepted into the buyer&#8217;s account.  Each week I check all outstanding domains that have yet to be claimed and I send a reminder to each buyer to claim the domain paid for.  I will usually continue to do this for about two or maybe three months before I will consider the domain unclaimed and at that point will mark it to be resold.</p>
<p>This current incident began when I sold a domain on eBay in May 2009.  The ending price was around $15.  The buyer paid for the domain and all was good.  I pushed the domain to the buyer but they had not accepted it.  I sent reminders each week and in July (almost two months later) the buyer replied to my eBay message &#8220;Thanks for the reminder, I haven&#8217;t had time to do it yet.&#8221;.  I continued to send reminders until the end of July at which point I stopped reminding the buyer.</p>
<p>Fast forward to May 2010.  I marked this particular domain as unclaimed by the buyer and put it up for resell.  Someone purchased it, I pushed it, they claimed it and all was good.</p>
<p>Now move forward to September 2010.  The buyer that purchased the domain from me on eBay in May 2009 sends me an email asking why he was not able to setup his website with Godaddy?</p>
<p>I responded to the buyer telling them that they had not claimed the domain within the alloted time and I had sold it to someone else.  I also stated that per my terms no refund would be given.</p>
<p>The buyer responds back that it should not matter how long it takes them to setup a domain that it should be &#8220;theirs&#8221; once they pay for it.  I continue to reiterate my policy and pointed out that they had not claimed their &#8220;product&#8221; after multiple reminders and even after they had acknowledged it.  In further email correspondence with the buyer they explain how their spouse was in the hospital at that time, they had to support their kids, and work full time, etc. Now I understand that people get into bad situations and I did feel a bit sorry for this person, but the fact is that they never claimed the domain which takes all of about five minutes to do.  In addition, they never contacted me letting me know their situation or to ask me to keep the domain on &#8220;hold&#8221; until they could get around to claiming it.  Another issue I pointed out was that since they never claimed the domain I had to pay renewal fees to keep the domain so the $15 they paid me was really going for the domain&#8217;s &#8220;upkeep&#8221;.</p>
<p>At this point I have not given the buyer a refund.  Even if I did offer a refund I would only want to give them about 1/2 of what they paid since I had to pay for renewal of the domain.  In addition, the second time I sold the domain the price was only $10.  So all-in-all my profit on this particular domain was quite low.</p>
<p>Now the buyer felt that I came across &#8220;angry&#8221; at them in my responses and that I should be happy since they gave me money for nothing in return.  If it had not been almost one and half years after paying and the fact that I made almost no profit off this domain then I might feel differently toward the buyer. Had we been talking a huge amount of money (and I know the word huge is relative) then I would probably have a different view on this matter. It would seem to me that since they did not contact me sooner then they did not care about the product they purchased.</p>
<p>Now I&#8217;m asking you, my reader, to give me feedback as to what you think I should do?  Am I right in sticking to my policy and not giving the buyer a refund?  Should I make the buyer happy no matter what and refund his money?  I have hundreds of happy buyers and always strive to make my customers happy, but their has to come a point where you be sensible about it.  Am I being too harsh or is this the price of being negligent on the part of the buyer?</p>
